Title IX
What is Title IX?
Title IX is a federal law that prohibits discrimination on the basis of sex under any education program or activity of Virginia Beach Theological Seminary (VBTS) receiving federal financial assistance.
Title IX states: “No person in the United States shall, on the basis of sex, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any education program or activity receiving Federal financial assistance.”
The United States Department of Education Office For Civil Rights is responsible for assessing university compliance with Title IX.
What protections does Title IX provide?
Educational programs and activities that receive ED funds must operate in a nondiscriminatory manner.
Title IX is intended to protect students, employees, and third parties to ensure no one is denied access to, or is limited in their educational programs and activities because of sexual discrimination.
Some key issue areas in which recipients have Title IX obligations are: recruitment, admissions, and counseling, financial assistance, athletics, sex-based harassment, treatment of pregnant and parenting students, discipline, single-sex education, student housing, and employment. (It is noted that athletics and student housing does not apply to VBTS, but they are included for definition purposes.) Also, a recipient may not retaliate against any person for opposing an unlawful educational practice or policy, or making charges, testifying or participating in any complaint action under Title IX. For a recipient to retaliate in any way is considered a violation of Title IX.
Under Title IX of the Education Amendments of 1972 and its implementing regulations, an institution that receives federal funds must ensure that no student suffers a deprivation of his or her access to educational opportunities based on sex.
Notice of Non Discrimination
VBTS does not unlawfully discriminate in enrollment, employment, or scholarship opportunities or practices on the basis of race, color, national origin, sex, age, or disability except when an otherwise protected characteristic is a bona fide occupational qualification or business necessity.
